Suspension of Temporary Status for Myanmar Nationals in the USA

On Monday, November 25, 2025, the Trump administration announced the suspension of the temporary legal status for Myanmar nationals residing in the USA. The Ministry of Internal Security states that the situation in the country has improved, and they can now safely return home. Officials are focusing on planned elections, as well as on the evidence of improved conditions.
The suspension of status has caused concern among those who may be forced to return to Myanmar, where since 2021 a political crisis has been ongoing following a military coup that led to armed conflict.
Interior Security Secretary Kristi Noem noted that in cooperation with government agencies, it was decided that the temporary protection for Myanmar is no longer necessary. She emphasized that improvements in governance and stability have taken place in the country, including the completion of a state of emergency and plans for free elections.
However, international organizations, such as the UN, indicate that these elections cannot be free and fair, especially since some opposition parties remain banned, while former leader Aung San Suu Kyi still remains in custody.
The suspension of status affects nearly 4000 Myanmar nationals, the deadline for which is January 26, 2026. In a report by the US State Department, published in September, serious human rights violations in Myanmar were noted, including cases of extrajudicial killings and disappearances, torture, persecution of journalists, and restrictions on freedom of religion.
According to reports, since the beginning of the year, the situation regarding human rights in Myanmar has worsened, with a significant increase in aviation raids and artillery shelling from the military regime.
It is worth noting that the temporary protective status for Myanmar was extended for 18 months during the Biden administration, but now it is suspended by the Trump administration, which actively suspends such statuses for nationals from different countries.
