On Monday, the federal court dismissed the criminal cases against former FBI Director James Comey and New York State Attorney General Letitia James. The court in the Southern District of New York upheld the ruling that prosecutor Lindsey Halligan was unlawfully appointed, which effectively voided all actions related to her appointment.

The court's decision left open the possibility for prosecutors to present new charges, although this may be constrained by the statute of limitations. The prosecution may file an appeal to the Fourth Circuit Court of Appeals, and possibly, further to the Supreme Court.

The charges against Comey related to his testimony before Congress in 2020, the statute of limitations for which expires on September 30. Although the law allows for new charges to be filed within six months after the dismissal of previous ones, the court noted that this may not apply, as the charges were deemed invalid from the outset.

Letitia James was charged with bank fraud, but the statute of limitations for her case has not yet expired. Officials in the Trump administration confirmed that they plan to challenge the court's ruling.
