Deportation of Venezuelans to El Salvador Raised Questions in Court

The Secretary of the Department of Homeland Security Kristi Noem was responsible for the ruling on the deportation of Venezuelan individuals to El Salvador, despite the federal court ruling that required the return of flights with deportees. This was reported by the Department of Justice in a submission to the court.
In early 2025, Judge James Boasberg issued an oral ruling, along with a written order that barred the deportation of individuals who fell under the provisions of the Law on Asylum Seekers. However, despite these orders, deportations were carried out, and flights with 261 passengers were sent to El Salvador.
The submission from the Department of Justice states that Noem received legal counsel and ruled that individuals who were removed under the court ruling may be sent back to El Salvador. This decision has led to new investigations into possible misconduct from the Trump administration.
Judge Boasberg began an inquiry into possible contempt of court, as earlier orders were not carried out appropriately. The Department of Justice aims to prove that their actions did not violate court orders.
Meanwhile, the appellate court allowed the investigation to continue in the case concerning deportations, and possible witnesses from Trump administration officials may be summoned to testify in the case regarding misconduct.
