Court Ruling on Activist's Detention

A federal judge has ruled that the Trump administration can no longer detain activist Mahmoud Khalil, a Columbia University graduate and Palestinian.

In his ruling, effective from 9:30 AM on Friday, Judge Michael E. Farbiarz noted that this allows the government to appeal if they wish to do so.

Mahmoud Khalil has been held at a detention center in Louisiana since March. Earlier this month, he shared his experience upon learning of his son's birth, saying, "When I heard my son's first cries, I buried my face in my hands so no one could see me cry."

Justification of the Court's Decision

The judge also prohibited the government from attempting to deport Khalil based on a determination by Secretary of State Marco Rubio, who claimed that Khalil posed a national security threat.

Rubio cited a little-known provision of the Immigration and Nationality Act of 1952, which allows the Secretary of State to "personally determine" whether Khalil should remain in the country.

Khalil actively participated in protests against the war in Gaza on campus last year and was arrested by federal agents in March.
