Court Decision Regarding the State Department

A federal judge in San Francisco on June 13, 2025, prohibited Secretary of State Marco Rubio from continuing plans to reduce the State Department. Judge Susan Illston stated that this was prohibited behavior under a court order issued a month earlier.

Judge Illston barred the Republican administration from implementing most of its reorganization plans while legal challenges from unions and other organizations are being considered. She noted that President Donald Trump did not seek support from Congress when he ordered cuts to government spending.

At the end of May, the State Department informed Congress about an updated reorganization of the agency, which involved even deeper cuts to programs and personnel than previously reported.

This week, Rubio also ordered U.S. embassies to fire all remaining staff of the U.S. Agency for International Development. According to him, the State Department will take over USAID's international assistance programs by Monday.

The Trump administration claims that Rubio initiated the reorganization of the State Department independently of the president's order and is therefore exempt from restrictions. However, Illston, who was appointed by former President Bill Clinton, disagreed with this.

"If the State Department has questions about whether planned actions fall within the scope of the court order, the court orders the department to first bring these questions to the court before taking action," she wrote in her ruling.
